About these terms

These terms are an agreement between you and Comfyness LLC ("Comfyness", "we", "us"), the operator of comffyness.com. They apply to all visitors and customers. Our Privacy Policy, Shipping Policy, Returns & Refunds and Payment Policy are part of these terms.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method.

Your account

You can check out as a guest or create an account. If you create an account, keep your password confidential. You are responsible for activity under your account. Tell us right away if you suspect unauthorized use.

Products and descriptions

We describe and photograph products as accurately as we can. Colors may look slightly different depending on your screen, and measurements can vary slightly. Some items are clearly labeled as pre-owned. These have been checked and graded, and the condition is stated on the product page.

Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if an item is out of stock, if we suspect fraud, or if there is an error in price or description. If we cancel an order you have paid for, we will refund you in full.

Prices and payment

All prices are shown in US dollars. Sales tax, where applicable, and shipping charges are calculated and shown at checkout before you pay. If a product is listed at an incorrect price due to an error, we may cancel the order and refund you. See our Payment Policy for accepted payment methods.

Shipping, title and risk

We ship to addresses in the United States. Title and risk of loss pass to you when the order is delivered to the address you provide. Delivery estimates are not guaranteed. See our Shipping Policy for details.

Returns and refunds

Acceptable use

You agree not to misuse the website, including by attempting to gain unauthorized access, interfering with its operation, scraping content, placing fraudulent orders, or using it for any unlawful purpose.

Intellectual property

The website and its content, including text, graphics, logos and the Comfyness name, are owned by or licensed to Comfyness LLC and protected by law. You may not copy or use them without our written permission.

Disclaimer

The website and products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these terms limits rights you have under applicable consumer protection law.

Limitation of liability

To the fullest extent permitted by law, Comfyness LLC will not be liable for indirect, incidental, special or consequential damages. Our total liability for any claim related to a product or order will not exceed the amount you paid for that order.

Indemnification

You agree to indemnify and hold harmless Comfyness LLC from claims arising from your misuse of the website or violation of these terms.

Disputes and governing law

If you have a concern, please contact us first at contact@comffyness.com. Most issues can be solved quickly this way. These terms are governed by the laws of the State of South Carolina, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Greenville County, South Carolina, unless applicable law requires otherwise.

Changes to these terms

We may update these terms from time to time. The version posted when you place an order applies to that order.
